Please read these Terms and Conditions (“Agreement”) carefully before using www.LocalLens.com (“the Site”) operated by Local Lens LLC (“us,” “we,” or “our”).

The words “you” and “your” refer to the user of the Local Lens website or Services, or the person on whose behalf that person accesses or uses them. The words “Photographer” and “Photographers” refer to the independent contracted photographers selected by Local Lens and assigned to you after making a booking. The words “Third Party” and “Third Parties” refer to selected third parties who may offer related services, including but not limited to providers of print products and merchandising. We reserve the sole right to select such Third Parties.

By clicking “Accept,” or by using the Site in any manner, you agree to be bound by this Agreement.

1. General

This Agreement governs your use of the Local Lens website and Services, including booking Photographers, attending photo shoots, downloading digital image files, ordering prints, and participating in any promotions run by Local Lens.

If you are under 18 years of age, you must obtain permission from a parent or legal guardian before using the Services.

We reserve the right to deny or discontinue Services at any time if we determine that you have failed to comply with any provision of this Agreement. User data is subject to our Privacy Policy, which is incorporated into this Agreement by reference.

Local Lens acts as an undisclosed agent between you and independent Photographers at destinations around the world. All Photographers are independent contractors operating their own photography businesses. You shall not request information regarding specific Photographers beyond what we provide for the purpose of your booking.

2. Our Services

You may browse Photographer portfolio samples and location information before making a booking. To reserve a session, you will be directed to complete payment for your selected service.

Within a reasonable time after receiving payment, we will contact an independent Photographer at your selected destination, confirm the date and time, and coordinate the service reserved. We do not guarantee the selection of any particular Photographer. We will provide a booking confirmation containing the confirmed date and time, the assigned Photographer’s contact details, and the meeting location.

Session Extensions: During your shoot, you may request to extend your session if the Photographer is available. Extension rates will be confirmed at the time of the request. Payment for any extension must be received before photos are delivered. If payment is not received, photos for the entire shoot will be withheld until payment is completed.

Lateness: If you arrive more than 10 minutes late, any elapsed time from your original start time is forfeited. You may shoot for the remainder of your booked time, and the number of delivered photos may be adjusted to reflect actual time spent.

Photo Delivery: The Photographer will professionally retouch selected photos and upload them to a server designated by Local Lens. Once confirmed, Local Lens will send you a download link. Local Lens is not responsible for the protection of photo links or the duration of their accessibility.

Video & Drone Services: Local Lens occasionally facilitates video and drone photography services. Drone sessions are subject to applicable aviation regulations, local airspace restrictions, and private property permissions. You are responsible for ensuring your requested shoot location permits drone operation. Local Lens is not liable for sessions canceled or altered due to regulatory restrictions on drone use.

3. Photographing Minors

If any person under 18 will be photographed during your session, you represent and warrant that you are the parent or legal guardian of that minor, or that you have obtained written consent from their parent or legal guardian prior to the shoot. By booking a session that includes a minor, you grant Local Lens and the assigned Photographer permission to photograph that individual under the terms of this Agreement. You agree to indemnify and hold harmless Local Lens and the Photographer from any claims arising from the photographing of minors where proper consent was not obtained.

4. Booking a Service

Bookings are not finalized until you receive a confirmation email containing your assigned Photographer’s details, the shoot location, and the meeting point. Although rare, circumstances beyond our control may require us to adjust the scheduled date or time. If we are unable to arrange a mutually suitable alternative, a full refund will be issued, excluding any transaction or currency conversion fees.

Hotel Restrictions: Some hotels do not permit outside photographers on their premises. It is your responsibility to confirm your venue’s photography policy before booking. If your hotel enforces a strict no-photography rule, the Photographer will offer to reschedule or suggest an alternative location. If you are unwilling to reschedule or accept an alternative, the booking will be treated as a last-minute cancellation and no refund will be offered.

Weddings & Elopements: Local Lens packages are designed for lifestyle and casual photography and are not intended to cover weddings or elopements. If you inquire about wedding photography, the assigned Photographer may request additional payment beyond our standard packages at their sole discretion.

Electronic Communications: By booking through Local Lens, you consent to receive communications from us electronically. It is your responsibility to provide accurate contact information. Local Lens is not responsible for non-receipt of communications caused by incorrect contact details, spam filters, or factors outside our control. If you do not receive a confirmation email within one hour of booking, please contact us at info@LocalLens.com.

5. Refund Policy

Cancellations by you:

The payment processing fee reflects the actual fee charged by our payment processor at the time of transaction and is subject to change.

Rescheduling Customers may reschedule a booking once at no charge, provided the request is made at least 7 days before the original shoot date. Rescheduled shoots must take place within 90 days of the original date. A second reschedule request will be treated as a cancellation under the standard policy.

Partial Sessions If you leave a session early of your own accord, no partial refund will be issued. The session is considered fulfilled for the time the Photographer was present and available.

Gift Cards: Gift cards are non-refundable but transferable to another person or booking.

Photographer Transportation: Any prearranged transportation costs incurred by the Photographer are non-refundable.

Completed Sessions: Once photos have been delivered and downloaded, no refund will be issued. The service is considered complete at that point. If additional retouching is desired, we can accommodate such requests separately.

Chargebacks: By agreeing to these Terms, you acknowledge that initiating a chargeback or payment dispute through your bank or card provider instead of following our refund policy constitutes a breach of this Agreement. In the event of a chargeback, Local Lens reserves the right to dispute the claim, recover associated fees, and suspend or terminate your access to the Site.

6. Weather Policy

Photo shoots may be conducted year-round, rain or shine. The Photographer may adjust the shoot location at their discretion to account for weather conditions.

Adverse Weather at Destination: If weather significantly impacts the session, the Photographer will work with you to reschedule or identify an alternate location. If you cannot accept an alternative due to weather, the standard cancellation policy applies. If the Photographer has no alternate availability and weather poses an unacceptable risk, the shoot cost will be refunded minus the payment processing fee and any transportation costs already incurred by the Photographer.

Travel Disruptions at Your Home Location: Weather-related disruptions preventing you from reaching the destination are not covered under this weather policy and fall under the standard cancellation policy. We strongly recommend purchasing travel insurance.

7. Health, Safety & Illness

We strongly recommend that all customers maintain health and travel insurance adequate to cover accidents, illness, or emergencies while traveling or attending a photo shoot.

Photoshoots canceled at short notice due to illness will be rescheduled where possible. If rescheduling is not feasible, no refund will be offered. Illness — including COVID-19 — does not qualify as an extenuating circumstance and is subject to the standard cancellation policy.

8. Prices & Additional Fees

All prices are expressed in US Dollars (USD). Customers in Texas, USA are subject to a Goods and Services Tax (GST) of 8.25%. Sales outside of Texas are not subject to this tax. We reserve the right to alter prices at any time without prior notice.

There may be additional costs associated with your session, including but not limited to transportation, parking, venue admission fees, permit fees, and activity costs for the Photographer. These are the responsibility of the customer.

9. Copyright & Intellectual Property

9.1 Photographer Copyright Ownership

The Photographer retains full copyright ownership of all images, videos, and other media created during any Local Lens session (“Session Content”). Nothing in this Agreement transfers copyright ownership from the Photographer to Local Lens or to the customer.

9.2 License Granted to Local Lens by Photographers

By accepting a booking through Local Lens — and in consideration of the business opportunities, platform access, and compensation provided — each Photographer grants Local Lens LLC an irrevocable, perpetual, worldwide, royalty-free, fully paid-up, non-exclusive license to:

• Reproduce, publish, distribute, display, and transmit Session Content in any format or medium, whether now known or hereafter developed
• Use Session Content across all Local Lens marketing channels, including but not limited to the website, mobile applications, email campaigns, paid advertising, social media platforms, print materials, and partner platforms
• Edit, crop, resize, reformat, and otherwise adapt Session Content for the above purposes, provided such adaptations do not materially misrepresent the Photographer’s work
• Sublicense Session Content to authorized Local Lens business partners and affiliates solely for the purpose of promoting Local Lens services

This license does not transfer copyright ownership and does not restrict the Photographer’s right to use, display, or license their images independently, except as outlined in Section 9.5.

9.3 Moral Rights

To the fullest extent permitted by applicable law, each Photographer waives any moral rights or equivalent rights they may hold in Session Content with respect to Local Lens’s use under Section 9.2. Where such waiver is not permitted by law, the Photographer agrees not to exercise those rights in a manner that restricts Local Lens’s use of Session Content as described in this Agreement.

9.4 License Granted to Customers

Customers are granted a perpetual, personal, non-exclusive, non-transferable, non-sublicensable license to use Session Content for personal, non-commercial purposes only, including sharing on personal social media accounts with appropriate Photographer credit.

This license does not permit:

• Commercial use, advertising, or promotion of any product or service
• Resale, licensing, or transfer of images to any third party
• Use in any AI training dataset, generative model, or automated system
• Modification or creation of derivative works without the Photographer’s written consent
• Any use that misrepresents or damages the reputation of the Photographer or Local Lens

License Revocation: Violation of any condition of this license results in automatic revocation without notice. Local Lens and/or the Photographer reserve the right to pursue all available legal remedies.

9.5 Photographer Non-Compete Restrictions

Session Content created during a Local Lens booking may not be used by the Photographer to:

• Promote, advertise, or market their services on any competing photography platform or booking marketplace
• Sell or license Session Content to any direct competitor of Local Lens
• Use Session Content in any way that directly undermines Local Lens’s commercial interests

Photographers retain the right to display Session Content in their personal portfolios, on their own website, and on general-purpose social media platforms, provided Local Lens is credited.

9.6 User Generated Content

If you voluntarily share or tag Session Content on social media in a manner that references Local Lens, you grant Local Lens a non-exclusive, royalty-free, worldwide license to reshare and display that content for promotional purposes. Local Lens will make reasonable efforts to credit you when resharing.

9.7 Copyright Infringement Claims

If you believe any content on our Site infringes your copyright, please notify us in writing at info@LocalLens.com with: (1) your authorized signature; (2) identification of the copyrighted work; (3) identification and location of the infringing material; (4) your contact information; (5) a good-faith belief statement; and (6) a statement of accuracy and authorization to act on behalf of the copyright owner.

10. Privacy & Data Protection

Local Lens collects and processes personal data as described in our Privacy Policy, incorporated into this Agreement by reference. By using our Services, you consent to such collection and use.

If you are located in the EEA, United Kingdom, California, or another jurisdiction with applicable data protection laws, you may have additional rights regarding your personal data. Please contact us at info@LocalLens.com to exercise these rights.

11. Dispute Resolution & Class Action Waiver

We encourage you to contact us first at info@LocalLens.com to resolve any concern informally. If a dispute cannot be resolved informally within 30 days, both parties agree to attempt resolution through non-binding mediation before pursuing litigation.

Class Action Waiver: To the fullest extent permitted by law, you agree that any dispute will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against Local Lens. This waiver applies regardless of how the dispute arises.

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, United States. The courts of Texas shall have primary jurisdiction over disputes arising from this Agreement. You acknowledge that enforcing judgments across international borders may require separate legal proceedings in the relevant jurisdiction.

12. Limitation of Liability

To the fullest extent permitted by law, Local Lens LLC and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site or Services. Where liability cannot be fully excluded, our total liability shall not exceed the amount paid by you for the specific booking giving rise to the claim.

Local Lens is not responsible for losses not caused by our breach; indirect or consequential losses; loss of revenue, profit, or business opportunity; data loss; loss of goodwill; system failures; or failures caused by Events Beyond Our Control.

13. Force Majeure

Local Lens shall not be liable for any failure or delay in performing its obligations under this Agreement where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions or restrictions, war, terrorism, civil unrest, internet or telecommunications outages, power failures, labor disputes, or any other event that could not have been reasonably anticipated or prevented (“Force Majeure Event”).

In the event of a Force Majeure Event, Local Lens will notify you as soon as reasonably practicable and will make reasonable efforts to resume normal operations. If the Force Majeure Event prevents Local Lens from delivering Services for more than 30 days, either party may terminate the affected booking and Local Lens will issue a credit or refund at its reasonable discretion, minus any non-recoverable costs already incurred.

14. Photographer & Third Party Liability

Photographer Liability: Local Lens acts as an agent in organizing photo shoots and is not a provider of photographic services. The Photographer is fully responsible for any loss, injury, illness, damage, or claims arising from their services. Your attendance at a photo shoot is entirely at your own risk. If a Photographer agrees to shoot on private property or aboard private vessels, that decision is made at the Photographer’s sole discretion and Local Lens bears no liability for any incident arising from such sessions.

Third Party Liability: For products or services purchased through Third Party suppliers, that Third Party is solely responsible for any loss, injury, or damage arising from their products or services.

15. Indemnification

You agree to indemnify, defend, and hold harmless Local Lens LLC and its officers, directors, employees, agents, Photographers, and Third Parties from any claims, damages, losses, liabilities, costs, and expenses — including reasonable attorneys’ fees — arising from: (a) your use of the Site or Services; (b) your violation of this Agreement; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Site.

16. Complaints

If you encounter a problem on the day of your shoot, please bring it to your Photographer’s attention immediately. If you remain dissatisfied, contact your Photographer directly or email us at info@LocalLens.com.

Sample photographs on our Site are for illustrative purposes only and do not constitute a warranty or guarantee of final photo quality or style.

17. Warranty Disclaimer

The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind — express or implied. Local Lens does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

18. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of this Agreement shall continue in full force and effect.

19. Termination

We may terminate your access to the Site at any time, with or without cause or notice. All provisions that by their nature should survive termination — including ownership, warranty disclaimers, indemnification, and limitations of liability — shall remain in effect.

20. Changes to This Agreement

We reserve the right to modify this Agreement at any time by posting updated terms on the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Agreement. Updated terms apply to all current and future bookings. In the event of any discrepancy between these Terms and other content on the Site, this Agreement takes precedence.
